1. Acceptance of Terms

By accessing or using the services of VancouverFireplace.ca, a division of ROMA Heating & Cooling ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Provided

We provide fireplace installation, repair, maintenance, and related services throughout Metro Vancouver and the Fraser Valley. All services are subject to availability, scheduling, and our professional assessment of feasibility and safety.

3. Service Appointments

• Scheduling: Appointments must be scheduled in advance. We will make reasonable efforts to accommodate your preferred date and time.
• Cancellations: Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may be subject to a cancellation fee.
• Access: You must provide safe and reasonable access to the work area. We reserve the right to reschedule if access is inadequate or unsafe.
• Service Calls: Service call fees apply for diagnostic visits and may be credited toward repair costs if you proceed with recommended work.

4. Pricing and Payment

• Estimates: Written estimates are provided for installation and major repair work. Estimates are valid for 30 days unless otherwise specified.
• Pricing: All prices are in Canadian dollars and subject to applicable taxes. Prices may change without notice.
• Payment Terms: Payment is due upon completion of service unless other arrangements have been made in writing. We accept cash, credit cards, and e-transfers.
• Late Payments: Overdue accounts may be subject to interest charges and collection fees.

5. Warranties and Guarantees

Workmanship Warranty: We warrant our workmanship for one year from the date of service. This warranty covers defects in our installation or repair work but does not cover normal wear and tear, misuse, or damage caused by third parties.

Product Warranties: New equipment and parts are covered by manufacturer warranties. We will assist with warranty claims but are not responsible for manufacturer warranty terms or coverage.

Warranty Exclusions: Warranties do not cover damage caused by improper use, lack of maintenance, modifications by others, or circumstances beyond our control.

6. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

7. Customer Responsibilities

• Provide accurate information about your fireplace system and any known issues
• Follow all safety instructions and maintenance recommendations
• Ensure proper ventilation and clearances around fireplace equipment
• Schedule regular maintenance as recommended
• Notify us immediately of any problems or safety concerns
• Obtain necessary permits and approvals (we can assist with this process)

8. Safety and Compliance

All work is performed in accordance with applicable building codes, safety standards, and manufacturer specifications. We reserve the right to refuse service or recommend alternative solutions if we determine that requested work would be unsafe or non-compliant.

9. Emergency Services

Emergency services are available 24/7 for urgent issues such as gas leaks or equipment failures. Emergency service rates apply for after-hours calls. In case of gas leaks, evacuate immediately and call 911 or FortisBC emergency line (1-800-663-9911) before contacting us.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of ROMA Heating & Cooling or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

11. Dispute Resolution

Any disputes arising from these Terms or our services will be governed by the laws of British Columbia, Canada. You agree to attempt to resolve disputes through good-faith negotiation before pursuing legal action. Any legal proceedings must be brought in the courts of British Columbia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
